Kuhlmann Receives Unanimous Court of Appeals Verdict

Mary Margaret Kuhlmann, an attorney at HAT’s Gulfport office, received a unanimous Court of Appeals verdict on Nov. 26 in a wrongful death suit against Gulf Publishing Company. Kuhlmann also represented the Gulf Publishing Company during its first trial at the Harrison County Circuit Court in May, where she obtained a unanimous verdict in favor of the publishing company. The plaintiff appealed the verdict based on Daubert and Rule 702. The plaintiff claimed that the expert witness testimonies (given by Gulf Publishing’s psychiatrist and an accident reconstruction expert on behalf of the defendant) were incorrectly allowed by the Harrison County Circuit Court, as they were not based in fact. The court found the witness testimonies to be reliable, and it reaffirmed the circuit court’s initial ruling in favor of Gulf Publishing Company.
