Court of Appeals affirms trial court’s dismissal of medical malpractice suit in favor of HAT attorney Hagwood

The Hinds County Circuit Court for the State of Mississippi recently ruled in favor of HAT attorney Carl Hagwood when they dismissed a malpractice suit against a neurosurgeon. After the initial ruling, the plaintiff appealed, and in December 2020, the Mississippi Court of Appeals affirmed the case dismissal by the Hinds County Circuit Court on the grounds that the plaintiff’s expert witness failed to establish a breach of applicable standard of care and that the alleged failure to comply with the standard of care was the proximate contributing cause of the alleged injuries.
